Right to Know Professional Qualifications of Teachers and Paraprofessionals In compliance with the requirements of the Every Student Succeeds Act, the Cyber Academy of South Carolina would like to inform you that you may request information about the professional qualifications of your student’s teacher(s) and/ or paraprofessional(s). The following information may be requested: Whether the student’s teacher— o has met State qualification and licensing criteria for the grade levels and subject areas in which the teacher provides instruction; o is teaching under an emergency or other provisional status through which State qualification or licensing criteria have been waived; and o the college major and any graduate certification or degree held by the teacher. Whether the student is provided services by paraprofessionals and, if so, their qualifications. If you wish to request information concerning your child’s teacher’s and/ or paraprofessional’s qualifications, some of this information is accessible through the South Carolina Department of Education's (SCDE) Public Educator Lookup: https://ed.sc.gov/educators/public-lookup/ You may search for this information by entering the teacher's name directly or by accessing a listing of all teachers by district or school name. This listing only includes teachers currently employed in South Carolina's school districts. Information obtained through the SCDE Public Educator Lookup is intended for informational use only and is not an official record. If parents do not have access to the Internet or wish to receive additional information, please contact Jamie Scorsone at jscorsone@cyberacademysc.org or 864-671-0394. The information will be provided to you within a reasonable period of time, normally within three weeks of receiving your request.

Gavin's Law Compliance Policy The Heron Institute Gavin's Law Compliance Policy, to be implemented for all virtual academies, including: Heron Virtual Academy of South Carolina and Cyber Academy of South Carolina Effective Date: November 21st, 2023 Purpose: This policy is established to ensure compliance with Gavin's Law, Act 54 of 2023, within Cyber Academy of SC, and to promote safety and awareness among our students, parents or guardians, the public, and school personnel regarding the dangers and consequences of sexual extortion. Information and Assistance Definition of Sex Discrimination and Sexual Harassment (for Students):

  • Sex discrimination occurs when a person, because of his or her sex, is denied participation in or the benefits of any education program or activity that receives federal financial assistance.
  • Sexual harassment is conduct that: 1) is sexual in nature; 2) is unwelcome; and 3) denies or limits a student’s ability to participate in or benefit from a school's educational program or activity. Sexual harassment can be verbal, nonverbal or physical.
Definition of Sex Discrimination and Sexual Harassment (for Employees):
  • Sex discrimination occurs when a person who is qualified for a position at issue is subjected to an adverse employment action because of his or her sex.
  • Sexual harassment is defined as unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when: 1) submission to such conduct is made a term or condition of employment; 2) submission to or rejection of the conduct is used as a basis for employment decisions affecting the individual; or 3) the conduct has the purpose or effect of unreasonably interfering with the employee's work performance or creating an intimidating, hostile or offensive working environment.
Any individual who believes he/she may have experienced any form of sex discrimination or sexual harassment, or who believes that he/she has observed such actions taking place, may receive information and assistance regarding the School’s policies and reporting procedures through the Title IX Coordinator. Section 504 provides: "No otherwise qualified individual with a disability in the United States . . . shall, solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance . . . ." OCR enforces Section 504 in programs and activities that receive Federal financial assistance from ED. Recipients of this Federal financial assistance include public school districts, institutions of higher education, and other state and local education agencies. The regulations implementing Section 504 in the context of educational institutions appear at 34 C.F.R. Part 104. The Section 504 regulations require a school district to provide a "free appropriate public education" (FAPE) to each qualified student with a disability who is in the school district's jurisdiction, regardless of the nature or severity of the disability. Under Section 504, FAPE consists of the provision of regular or special education and related aids and services designed to meet the student's individual educational needs as adequately as the needs of nondisabled students are met.
